Terms of Service:
These Service Provisions (“Terms”) are a legally binding agreement between you and Itinerant LLC, which governs your use of the websites, applications, and other offers received from Itinerant LLC referred to as “Darrbak” or “we” shall refer to the entity that has a contract with you. It is important for you to read and understand the terms below carefully. It is considered the contract between you and Darrbak, and it states the basis of your legal relationship with Darrbak.
● Duration:
The agreement between you and Darrbak under these provisions shall be effective as soon
as you access the platform (for example, to create an account) and will remain in effect until
the termination of the agreement by you or with our knowledge in accordance with these
provisions.
● Scope of Service:
Darrbak acts as an intermediary between you and the cooperating experience providers
and through the system that enables you to complete the reservation. Therefore, reservations made through the system will be considered a direct contract between you and the experience provider that you booked with in accordance with the terms and conditions stipulated in the reservation.
● Prices and Payment:
All fees, charges, and taxes in connection with the services shall be payable to Darrbak in the
currency indicated on the booking confirmation. Our currency conversions are for informational purposes only and should not be relied upon as actual or in real-time, as actual rates may vary and your payment service provider may charge conversion or other fees.
The rates shown in the price list are informational and are denominated in Omani Rials (Omani Rials), and the prices for each experience are clearly indicated on the platform.
Darrbak reserves the right to adjust fares until you have made full payment for your experience.
Dates, prices, and itineraries are indicative only and are subject to change. Insurance is not
included in your price.
● Termination:
You may terminate your account at any time by directly deleting your account or sending us
an email or Darrbak may terminate your account for any reason upon 30 days’ notice issued
to you via e-mail, or through any other contact information that may be provided by you in
your account. Darrbak may also terminate your account with immediate effect and without
notice and suspend access to the Darrbak platform in the event you breach these provisions:
1- Our policies.
2- Your violation of applicable laws.
3- If we reasonably believe that termination is necessary to protect Darrbak, its members, or
third parties.
*If your account is deactivated for more than two years, we may cancel your account without prior notice.
● Risks:
There are certain inherent risks in Darrbak's offered experience the type involved here. These include, but are not limited to, risks of white water rafting, kayaking, and rafting (for example dangers of rapidly moving water, rocks, and other submerged objects, hypothermia, etc), hiking, climbing mountains (for example, rock slides, falling stones, etc), walking safaris, downhill or cross-country skiing, (for example, equipment failures, ice or other trail obstructions) and in all experiences dangers of animals, inaccessibility to medical attention and difficulty in evacuation from remote locations in the case of a medical emergency. Traveler assumes all such risks with regard to these possibilities.
*Discharge: Trail-beak engages in activities in areas where the standards of accommodation,
transportation, safety, hygiene, medical facilities, and other infrastructure, at specific times, may be different from those you normally expect. Please keep this in mind when making your reservation.
● Liability Waiver:
The undersigned/a (in the following, User), with reference to the activities (in the following experience) that he intends to carry out at the local guides (in the following, Experience Provider) declares to:
A. Be in good health and suitable and adequate to practice the outdoor sporting activity chosen.
B. Undertake to follow the instructions of the outdoor guide designated by the Experience
Provider and to take all appropriate conduct in order to carry out the Experience in complete safety in order not to cause damage, endanger and/or cause discomfort to himself or to anyone other person involved in the Experience.
C. Be aware of each activity related to the Experience and have the physical abilities, experience, technical skills, and specific knowledge of experienced sportsmen necessary to carry out with absolute autonomy and independence, at your own risk, the activities required by the Experience.
D. To assume any and all liability, civil and criminal, and for compensation for any damage to property, persons, and structures directly caused by him or attributable to his actions and conduct held during the development of the Experience as well as he assumes any risk for his own person.
E. To exonerate as of now for all purposes of reason and law, the Experience Provider and each
of his appointees from any and all responsibility, renouncing as of now to advance against
them, for any reason, claims for damages or compensation.
In light of the above, the User holds harmless, to the maximum extent permitted by law, the
Experience Provider and each person in charge of any material and non-material damage, direct or indirect, to his person, to third parties, and/or to equipment that should derive from participation in the Experience and which is not attributable to the Experience Provider and/or to his / her supervisors for willful misconduct or gross negligence.
